Terms of Service

These Terms of Service (the “Terms”) are a binding contract between you and VetTheHome LLC, a Washington limited liability company (“VetTheHome,” “we,” “us,” or “our”). They govern your access to and use of the VetTheHome website, property reports, software, and related services (together, the “Service”). Please read them carefully.
Please read — this affects your legal rights. Section 16 contains a binding arbitration agreement and a class-action waiver. Unless you opt out within 30 days as described in Section 16, you and we agree to resolve disputes on an individual basis through binding arbitration and to waive the right to a jury trial and to participate in class actions. Sections 13 and 14 limit our warranties and our liability to you.
1. Acceptance, Eligibility & Electronic Communications
1.1 Acceptance. By clicking to accept, creating an account, purchasing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1.2 Eligibility. You must be at least 18 years old and able to form a binding contract. You represent that you meet these requirements and that all information you provide is accurate.
1.3 Authority. If you use the Service on behalf of a business or other entity (for example, as a real-estate agent, brokerage, or investor entity), you represent that you are authorized to bind that entity, and “you” includes that entity.
1.4 Electronic communications (E-SIGN consent). You consent to receive all agreements, notices, disclosures, and other communications from us electronically — by email, by posting in the Service, or through your account — and you agree that this electronic delivery satisfies any legal requirement that such communications be in writing. You may withdraw this consent by closing your account, but doing so may prevent you from using the Service.
2. What the Service Is — and Is Not
2.1 What it is. VetTheHome compiles publicly available government and third-party records about real property in Washington State into automated, informational property reports and related tools, presented with per-category estimates and letter grades and a described methodology, for research and due-diligence purposes.
2.2 What it is NOT. The Service is not, and must not be relied upon as, any of the following:
- a consumer report, and VetTheHome is not a consumer reporting agency, under the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. — reports are about properties, not people (see Section 4);
- an appraisal, and no value figure is an appraisal, under chapter 18.140 RCW; any value figures are automated estimates generated by a model, not by a licensed or certified appraiser, and must not be used where an appraisal is required;
- a title search, title report, or title insurance;
- a home, building, sewer, structural, pest, or environmental inspection;
- a survey, engineering study, or professional risk certification;
- real-estate brokerage, or legal, financial, tax, insurance, or investment advice; and
- a substitute for your own professional inspections, independent investigation, or professional advisors.
2.3 No professional relationship. Your use of the Service does not create any fiduciary, advisory, brokerage, agency, or professional relationship between you and VetTheHome.
3. Informational Purpose, No Reliance & Assumption of Risk
3.1 Informational only. The Service, including all reports, grades, estimates, and data, is provided for general informational and research purposes only.
3.2 Independent verification. You acknowledge and agree that public and third-party records may be incomplete, outdated, mis-recorded, or inaccurate at the source; that automated grades and estimates are approximations, not determinations of fact or value; and that you will independently verify any information that matters to you — with the original source agency and with qualified professionals (inspectors, appraisers, title companies, attorneys) — before making any decision or taking any action.
3.3 Assumption of risk. You assume all risk of relying on the Service. Any decision you make, including whether to buy, sell, price, offer on, waive contingencies for, or invest in any property, is your sole responsibility and is made on your own independent judgment and investigation, not in reliance on the Service.
4. Prohibited Uses — FCRA Certification
4.1 Certification. As a condition of access, you certify that you will NOT use the Service, any report, or any data from it, in whole or in part, as a factor in establishing any person’s eligibility for, and you will not use it for any purpose governed by the FCRA, including:
- credit or the terms of credit;
- tenancy, housing, or residential rental (tenant screening);
- employment, promotion, reassignment, or retention;
- insurance underwriting or eligibility;
- a government license or benefit; or
- any other “permissible purpose” under 15 U.S.C. § 1681b or assessment of a person’s character, reputation, or creditworthiness.
4.2 Not a consumer report. You acknowledge that VetTheHome is not a consumer reporting agency, that reports are not consumer reports, and that data is not assembled or evaluated for FCRA purposes.
4.3 People-search & anti-harassment. You will not use the Service to search for, identify, or compile information about individuals; to harass, stalk, threaten, or harm any person; to make unsolicited contact with property owners; or to build marketing or contact lists, in violation of RCW 42.56.070(8) or otherwise. VetTheHome does not offer owner-name search, reverse-owner lookup, or owner-sorted exports on any plan.
4.4 Enforcement. Violation of this Section is a material breach and grounds for immediate suspension or termination without refund, and you are responsible for all liability arising from your prohibited use (see Section 15).
5. License, Acceptable Use & Restrictions
5.1 License to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and to use reports you purchase for your own personal or internal business due-diligence purposes.
5.2 Restrictions. You will not, and will not permit others to:
- scrape, crawl, harvest, or use bots or automated means to access or extract data from the Service, or otherwise access it at a rate or volume beyond normal individual use;
- resell, redistribute, sublicense, republish, or create derivative databases from the Service’s data or reports, except sharing an individual purchased report as the Service’s features allow;
- reverse engineer, decompile, or attempt to derive the underlying data compilation, source code, or methodology;
- circumvent usage limits, access controls, watermarking, or security; access areas or data beyond your authorization; or
- use the Service to violate any law or third-party right, or in any way that could damage, disable, or impair the Service.
6. Accounts & Security
6.1 Your account. Creating an account is free and lets you manage the reports you purchase; it does not include free access to full reports. You are responsible for your login credentials and for all activity under your account, and you agree to notify us promptly of any unauthorized use.
6.2 Accurate information. You agree to provide accurate account and billing information and to keep it current.
7. Purchases, Pricing & Taxes
7.1 Products. Reports are available as one-time purchases and through subscription plans that include monthly report credits, at the prices shown at checkout. Some one-time report purchases are available via guest checkout without an account; by completing checkout you agree to these Terms. We may change prices prospectively; changes do not affect purchases already made.
7.2 Payment. Payments are processed by our third-party payment processor. You authorize us and the processor to charge your selected payment method for all amounts due, including applicable taxes.
7.3 Taxes. Prices exclude applicable taxes unless stated. You are responsible for any sales, use, or similar taxes, which we may collect and remit as required by law.
8. Subscriptions & Automatic Renewal
8.1 Auto-renewal. Paid subscriptions automatically renew for successive periods (monthly or annually, as you select) at the then-current price, and your payment method will be charged at the start of each renewal period, UNTIL YOU CANCEL. We will disclose the renewal terms clearly before you subscribe and obtain your affirmative consent to them.
8.2 Cancellation & what you keep. You may cancel at any time from your account settings (self-service online cancellation) or by contacting support. Cancellation stops future renewals; amounts already charged for the current period are not refunded (see Section 9). After cancellation, you keep access to reports you have previously purchased and accessed, and any report credits already in your account remain usable until their normal 12-month expiration (Section 9.3).
8.3 Acknowledgment, reminders & price changes. After you subscribe we will send an acknowledgment of the terms and how to cancel. We will provide renewal reminders and advance notice of any price increase, with cancellation information, as required by applicable law.
9. Refunds — All Sales Final; Defective-Report Exception
9.1 All sales final. All purchases — including single reports, subscription charges, and report credits — are final and non-refundable, except as expressly provided in this Section or as required by non-waivable law. VetTheHome does not offer a money-back or satisfaction guarantee.
9.2 Defective-report exception. If a report you accessed is materially defective — for example, it failed to generate, or omitted key data categories it normally provides, because of a technical error attributable to the Service — contact us at support@vetthehome.com and we will, at our option, regenerate the report, restore the credit used, or refund that report. This is your sole and exclusive remedy for a defective report. Dissatisfaction with the content of an accurate report, or with what public records do or do not show, is not a defect and is not eligible for a refund.
9.3 Report credits. Report credits included with a subscription (or otherwise added to your account) are valid for 12 months and expire on a rolling, month-by-month basis. Reports you have already unlocked remain available and do not expire. Expired credits have no value and are not refundable, extendable, or redeemable, except as required by law.
9.4 Subscriptions. You may cancel a subscription at any time (Section 8). Cancellation stops future renewals; amounts already charged for the current period are non-refundable. Cancellation does not forfeit report credits already in your account, which remain usable until their normal 12-month expiration, and you keep access to reports you have previously purchased and accessed.
9.5 Consumer rights. Nothing in this Section limits any non-waivable refund or cancellation right you may have under applicable law.
10. User Content & Agent Branding
10.1 Your content. If you upload content — for example, a logo, headshot, business name, or profile information for branded agent reports (“User Content”) — you grant VetTheHome a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that User Content solely to provide and promote the Service and your branded reports.
10.2 Your representations. You represent and warrant that you own or have all rights to your User Content, that it does not infringe or violate any third-party right or any law, and that it is accurate and not misleading. You are solely responsible for your User Content.
10.3 Removal. We may remove User Content that violates these Terms or that we reasonably believe creates risk, without liability.
11. Intellectual Property
11.1 Our IP. The Service — including its software, design, text, graphics, report formats, grading methodology, scoring, selection, arrangement, and compilation of data, and all trademarks and branding — is owned by VetTheHome and protected by intellectual-property laws. While individual public records are not themselves copyrightable, our compilation, analysis, presentation, and grading of that data are proprietary. We reserve all rights not expressly granted.
11.2 Feedback. If you send us suggestions or feedback, we may use them without restriction or obligation to you.
12. Third-Party Data & Sources
The Service relies on data from government agencies and third-party sources (including, for example, county assessors, municipal permit systems, FEMA, and Washington state agencies). We do not control and are not responsible for the accuracy, completeness, or timeliness of source data, and inclusion of any data does not imply endorsement. Source records may themselves be incomplete or incorrect; always verify with the original source agency (see Section 3).
13. Disclaimer of Warranties
The Service, including all software, reports, grades, estimates, and data, is provided “as is” and “as available,” with all faults and without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, VetTheHome disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.
VetTheHome does not warrant that the Service or any report, grade, estimate, or data is accurate, complete, current, reliable, or error-free, or that the Service will be uninterrupted or secure. No advice or information, whether oral or written, creates any warranty not expressly stated here.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case such warranties are limited to the minimum scope and duration permitted by law.
14. Limitation of Liability
To the maximum extent permitted by law, VetTheHome and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, or for the cost of any property, transaction, repair, or remediation, arising out of or relating to the Service or your reliance on it, whether in contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages.
VetTheHome’s total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid to VetTheHome in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
These limitations do not apply to liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or fraud, or certain non-waivable statutory consumer rights. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. The parties agree this allocation of risk is reflected in the pricing of the Service.
15. Indemnification
You will defend, indemnify, and hold harmless VetTheHome and its members, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms, including the FCRA certification and prohibited uses in Section 4; (c) your User Content; or (d) your violation of any law or third-party right. We may assume the exclusive defense of any matter subject to indemnification, and you will cooperate with us.
16. Dispute Resolution — Arbitration, Class-Action Waiver & Opt-Out
16.1 Informal resolution first. Before starting an arbitration, you and we agree to try to resolve the dispute informally for at least 60 days after written notice describing the dispute, the party’s name and contact information, and the relief sought. An individualized written notice is a condition precedent to arbitration, and the deadline to file is tolled while the parties confer in good faith.
16.2 Binding arbitration. Except as provided below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, and not in court. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
16.3 Class-action & jury waiver. You and we agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class proceeding. You and we waive any right to a jury trial.
16.4 Coordinated / mass filings. If 25 or more similar arbitration demands are asserted by or with the coordination of the same or common counsel, the demands will be administered in staged batches (with a single arbitrator per batch and bellwether cases decided first to inform resolution of the remainder), and related fees will be assessed on a staged basis. Statutes of limitation are tolled for demands awaiting their batch.
16.5 Claim authenticity. Each claimant and their counsel must certify that the information supporting the individual claim is true and that the claim is brought in good faith on that claimant’s own behalf.
16.6 Small-claims carve-out. Either party may instead bring an individual claim in a small-claims court that has jurisdiction.
16.7 Delegation. The arbitrator has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court decides the enforceability of the class-action waiver in Section 16.3.
16.8 30-day opt-out. You may opt out of this Section 16 by emailing legal@vetthehome.com with your name, account, and a clear statement that you opt out, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
16.9 Severability & survival. If Section 16.3 is found unenforceable as to a particular claim for relief, that claim will proceed in court but the rest of this Section 16 remains in effect. This Section survives termination.
17. Time Limit to Bring Claims
To the extent permitted by law, any claim arising out of or relating to the Service or these Terms must be filed within ONE (1) YEAR after the claim accrues, or it is permanently barred. Where applicable law does not permit shortening the limitations period, this Section does not apply to that claim.
18. Governing Law & Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Subject to Section 16, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Nothing in this Section deprives you of the protection of mandatory consumer-protection laws of your home jurisdiction that cannot be waived by contract.
19. Changes to the Service or Terms
We may modify or discontinue the Service, in whole or part, at any time. We may update these Terms; if we make material changes, we will provide reasonable notice (for example, by email or in-Service notice) before they take effect, and, where appropriate, seek your renewed acceptance. Your continued use after changes take effect means you accept the updated Terms; if you do not agree, stop using the Service.
20. Suspension & Termination
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms (including Sections 4 and 5), if required by law, or to protect the Service or other users. On termination, your license ends; Sections that by their nature should survive (including 2–4 and 11–18, and 21–22) survive.
21. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, outages, failures of data sources or third-party providers, network or power failures, labor disputes, or governmental action.
22. General
22.1 Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior agreements and representations.
22.2 Severability. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions remain in full effect.
22.3 No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
22.4 Assignment. You may not assign these Terms without our consent; we may assign them, including in connection with a merger, acquisition, or sale of assets.
22.5 No third-party beneficiaries; headings. There are no third-party beneficiaries. Headings are for convenience only.
22.6 Survival. Provisions that by their nature should survive termination will survive.
23. Copyright / DMCA Notices
We respect intellectual-property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). To report content you believe infringes your copyright, send a notice with the information required by the DMCA to our designated agent: [DMCA Agent], [mailing address], dmca@vetthehome.com. See our DMCA / Copyright Policy for the full procedure. We may remove allegedly infringing content and terminate repeat infringers.
